The new decree introduces an updated enforcement framework for companies employing or hosting foreign nationals in Vietnam.<\/p>\n<p>Decree 283\/2026\/N\u0110-CP brings Vietnam\u2019s administrative penalty framework into line with the foreign-worker management regime introduced by <strong>Ngh\u1ecb \u0111\u1ecbnh 219\/2025\/N\u0110-CP<\/strong>, the current Work Permit Decree.<\/p>\n<p>While the fundamental principles governing the employment of foreign nationals remain largely unchanged, Decree 283 expands the scope of enforceable compliance obligations introduced under Decree 219 and generally increases the level of penalties applicable to employers.<\/p>\n<p>Importantly, foreign-worker compliance in Vietnam is increasingly about more than simply holding a valid <strong>Gi\u1ea5y ph\u00e9p lao \u0111\u1ed9ng<\/strong>. managing foreign specialists, technical experts or other international employees;<\/li>\n<li>HR and Global Mobility teams responsible for foreign-worker compliance;<\/li>\n<li>Companies managing the end of a foreign employee\u2019s assignment in Vietnam.<\/li>\n<\/ul>\n<p>The practical implications are especially important for employers that regularly manage international assignments, temporary projects or foreign employees working across different locations.<\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"1_Working_in_Vietnam_Without_the_Required_Work_Permit\"><\/span>1. What About the Work Notification Report for Assignments of Less Than 90 Days?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>One of the most important practical changes concerns short-term foreign workers.<\/p>\n<p>Under Decree 219\/2025\/N\u0110-CP, certain foreign nationals working in Vietnam for a total period of less than 90 days in a calendar year may qualify for an exemption from the Work Permit requirement.<\/p>\n<p>This category also does not require obtaining a Work Permit Exemption Certificate.<\/p>\n<p>However, this does not mean that no labour compliance formalities are required.<\/p>\n<p>Instead, the employer must notify the competent authority <strong>at least three working days before the foreign employee starts working in Vietnam<\/strong>.<\/p>\n<p>Decree 283 now expressly introduces a penalty for failure to comply with this notification requirement.<\/p>\n<p>An employer may face a fine of <strong>VND 1 million to VND 3 million<\/strong> for:<\/p>\n<ul>\n<li>failing to submit the required notification;<\/li>\n<li>submitting the notification late; or<\/li>\n<li>submitting an incomplete notification.<\/li>\n<\/ul>\n<p>The employer may also be required to complete the notification as a remedial measure.<\/p>\n<p>&nbsp;<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Does_Failure_to_Notify_Mean_That_the_Foreign_Employee_Is_Working_Illegally\"><\/span>Does Failure to Notify Mean That the Foreign Employee Is Working Illegally?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>This is an important distinction.<\/p>\n<p>A foreign national who genuinely qualifies for the less-than-90-days-per-calendar-year exemption is legally exempt from both the Work Permit and WPEC requirements under Decree 219.<\/p>\n<p>M\u1ed1c <strong>Work Notification Report<\/strong> is a separate employer compliance obligation.<\/p>\n<p>Decree 283 reinforces this distinction by creating a specific employer penalty for failure to comply with the notification requirement rather than expressly treating the missing notification itself as employment without a WP\/WPEC.<\/p>\n<p>Therefore, based on our reading of the new regulations, where the foreign employee genuinely satisfies all the conditions of the applicable exemption, failure to submit the Work Notification Report may result in:<\/p>\n<ul>\n<li>a fine for the employer, together with an obligation to complete the required notification; but<\/li>\n<li>no specific penalty for the foreign employee solely because the employer failed to submit the notification.<\/li>\n<\/ul>\n<p>This distinction is particularly relevant for multinational companies regularly sending employees to Vietnam for short-term projects, technical assignments, training or other temporary work activities.<\/p>\n<p>Companies should nevertheless ensure that the foreign national genuinely satisfies the conditions of the exemption. The notification procedure should not be viewed as an alternative to obtaining a Work Permit where the employee does not qualify for the exemption.<\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"3_Working_in_Multiple_Provinces_or_Cities\"><\/span>3. Working in Multiple Provinces or Cities<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Decree 219 introduced a more flexible framework allowing certain foreign employees to work for the same employer in multiple provinces or centrally governed cities, subject to notification requirements.<\/p>\n<p>Decree 283 now provides an explicit penalty where the required notification is:<\/p>\n<ul>\n<li>not submitted;<\/li>\n<li>submitted late; or<\/li>\n<li>submitted incompletely.<\/li>\n<\/ul>\n<p>The employer may face a fine of <strong>VND 1\u20133 million<\/strong> for failure to comply with the applicable multi-location notification requirement.<\/p>\n<p>This is particularly relevant for foreign employees whose responsibilities require them to travel regularly between factories, project sites, branches or client locations in different provinces.<\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"4_Employment_Inconsistent_with_the_WP_or_WPEC\"><\/span>4. Employment Inconsistent with the WP or WPEC<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Holding a valid Work Permit or WPEC does not, by itself, guarantee compliance.<\/p>\n<p>An employer using a foreign employee in a manner inconsistent with the information stated on the WP\/WPEC may face a fine of <strong>VND 5\u201310 million per employee<\/strong>, subject to a maximum of VND 75 million per employer.<\/p>\n<p>Companies should therefore ensure that the employee\u2019s actual working arrangements remain consistent with the authorisation obtained.<\/p>\n<p>Changes to an employee\u2019s role, work arrangements or other relevant circumstances should be reviewed from an immigration and labour compliance perspective rather than assuming that an existing Work Permit remains sufficient.<\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"5_Compliance_Obligations_Continue_at_the_End_of_an_Assignment\"><\/span>5.
