  • The position is approved by relevant authorities 
  • The employee has the required qualifications and experience

Who Needs a Work Permit in Vietnam? 

Generally, foreign nationals working in Vietnam require a work permit if they are employed by a Vietnamese entity.

However, some categories may qualify for exemptions depending on:

Vietnam Work Permit Requirements 

 

1. Passport Validity: A Detail That Can Block the Entire Process 

 

Before starting a Vietnam work permit application, companies should verify that the employee’s passport remains valid for the full duration of the intended assignment. 

 

A passport expiring soon can create complications because the work permit, visa, and Temporary Residence Card (TRC) are linked to the employee’s identity documents. 

 

For example, if an employee’s passport expires shortly after arrival: 

  • The work permit can only cover up to the expiry date of the assignee’s passport and not the full expected assignment or employment period 
  • The visa or TRC also cannot exceed the expiry date of the passport. The applicant will not be eligible for a TRC if the remaining validity duration of the passport or work permit is < 12 months.   
  • With a work visa instead of a TRC the foreign national will not be eligible to obtain a Vietnamese driving or hold bank debit or credit cards or a VNeID for administrative procedures 
  • The employee may need to update multiple work permit and immigration records 

 

For this reason, companies usually recommend that employees renew their passports before beginning the Vietnam relocation process if validity is not covering the expected initial work duration. 

 

A good rule of thumb is to ensure the passport has sufficient remaining validity before preparing any legalized documents required for work authorization or Immigration applications. 

 

2. Health Certificate Requirement for Vietnam Work Permit 

A valid health certificate is mandatory for most foreign employees applying for a Vietnam work permit. 

 

Health certificate required for work permit and work permit exemption certificate applications can either be issued by foreign competent health authorities in Vietnam or in overseas provided that the issuing country has mutual recognition agreements with Vietnam. 

 

However, as of today, there are no known treaties or agreements that allow for the mutual recognition of health examination results issued by foreign countries.

 

Therefore, in practice many foreign nationals required to apply for a Work Permit must complete the required medical examination in Vietnam. 

 

The medical examination is usually completed at an approved hospital or medical facility and is quite comprehensive : 

  • General physical check-up 
  • Blood pressure, height and weight 
  • Vision, hearing and dental checks 
  • Blood and urine tests 
  • Chest X-ray 
  • Review of medical history 
  • Doctor’s conclusion confirming whether the employee is fit to work 

 

Common mistakes include: 

  • Completing the examination at a facility whose certificate is not accepted

3. Education and Experience Requirements 

Vietnam does not simply issue work permits based on having a foreign job offer. The employee must demonstrate that they qualify for the position they are being hired for. 

 

For the most common category — foreign experts — the standard requirement is generally: 

  • A bachelor’s degree or higher (or equivalent qualification) 
  • At least 3 years of relevant professional experience matching the proposed position 

 

Alternative qualification routes may apply depending on the role, such as: 

  • Professional certificates combined with relevant experience

4. Visa Status Before Applying for a Vietnam Work Permit 

A common misunderstanding is that foreigners can simply arrive as tourists and start the work permit process. 

 

In reality, the immigration status must match the intended purpose of stay.

In many cases, employees enter Vietnam with an employer-sponsored business visa (DN visa) or another suitable immigration category before completing the work permit process.

 Important: Entering Vietnam as a tourist, business visa or e-visa does not give the right to work, receive a salary from a Vietnamese employer, or perform employment activities.

Recommended Document Preparation Order 

One of the biggest mistakes companies make is collecting documents randomly. 

A better approach is to prepare documents in an order based on processing time. 

 

Step 1 — Confirm Position Eligibility

  • Job title in Vietnam 
  • Employee category (expert, manager, technician, etc.)

Step 2 — Order the Longest-Lead Documents First 

 

1. Criminal Record / Police Clearance

Usually one of the slowest documents to obtain.

  • Size: 4cm × 6cm 
  • Taken within the last 6 months

  • Full face visible, without hats or sunglasses 

 

Preparing several copies is recommended, as the same photos may be needed for related immigration procedures such as the Temporary Residence Card application. 

 

Step 3 — Employer Submits Application 

As the sponsoring entity, the employer is responsible for coordinating and supporting the work permit application process. The application must first be submitted through the online portal before the original documents are lodged with the competent authority.

 

The foreign employee does not apply independently.

FAQ — Vietnam Work Permit 

How long is a Vietnam work permit valid? 

A Vietnam work permit is generally issued for a maximum period of two years and is linked to the employee’s specific employment arrangement and the applicable regulations. It may be renewed once, for a further maximum period of two years, provided the employee continues working in Vietnam and meets the renewal requirements. 

 

Are there different types of Work Permits in Vietnam? 

No, there are not different work permit “types” like visas or TRCs. Vietnam issues one main work permit, but the application is based on the working form and foreign worker’s category: 

  • Expert / Specialist → university degree (or equivalent) + relevant experience 
  • Manager / Executive → leadership or management roles 
  • Technical Worker → technical qualifications and experience 

 

Besides certain category of foreigner do not have to request a work permit but instead are eligible to apply for a Work Permit Exemption Certificate (investors, internal transfers under Vietnam’s WTO service commitments, Cases working under international treaties or agreements, etc.) 

 

Can I apply for a Vietnam work permit from abroad? 

Yes, preparation can begin before arrival. 

Many documents should ideally be prepared overseas, especially: 

  • Police clearance 
  • Assignment letter (when applicable) and its legalization 
  • Work Experience letter and its legalization 
  • Degree legalization 

However, some steps are often easier once the employee is in Vietnam, especially health checks. 

 

Is the employer responsible for the work permit? 

Yes. 

The Vietnamese employer is responsible for the application process and compliance. 

The employee provides documents, but the company usually manages submission and coordination with authorities. 

This also applies for the Immigration document for the main applicant (work visa, TRC) as well as the dependent (dependent visa, TRC) unless the employee is a spouse of Vietnamese National. 

 

Can I work while waiting for my work permit? 

Foreign employees should only commence work after the appropriate work authorization has been secured and all required approvals are in place. 

 

Starting work too early can create compliance risks for both the employee and employer. 

 

Does Vietnam reject work permit applications based on specific health conditions? 

Vietnam does not publish a general list of medical conditions that automatically prevent a foreign employee from obtaining a work permit. 

The health certificate is mainly used to confirm that the employee is medically fit to perform their assigned job. 

In practice, rejection is generally linked to a medical condition that prevents the employee from being considered fit for work rather than a specific diagnosis alone. Employees should complete the required medical examination at an approved facility before finalizing their work permit application. 

 

Can a Vietnam work permit be automatically renewed? 

No. A Vietnam work permit is not automatically renewed when it expires. 

The employer remains responsible for preparing and submitting a renewal application if the employee continues working in Vietnam. 

The renewal process usually requires updated documents, which may include: 

  • Valid passport and immigration documents

No, a work permit is linked to a specific employer, position and work location. If an employee changes companies, a new application is required. However in some cases, the old work permit may serve as a justification of the employee’s qualifications

Yes. Foreign-issued documents must be legalized and translated into Vietnamese. However Vietnam recently acceded to the Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents, also known as the Apostille Convention. The Convention will take effect starting from September 11, 2026 between Vietnam and other member states, replacing the multi-step consular legalization procedure with a single Apostille issued in the country of origin, administrative layers will be reduced, documentation timelines shortened, and overall costs lowered 

 

Is there a minimum wage applicable to foreigners in Vietnam? 

Foreign employees working in Vietnam are subject to the same regional minimum wage regulations as Vietnamese employees. There is no separate minimum wage for foreigners, although expatriate salaries are typically significantly higher than the statutory minimum. While Vietnam does not currently prescribe a specific minimum salary threshold for most foreign employees, the proposed salary should be reasonable and consistent with the position, qualifications, and market practice.
